What a Well Permit Doesn't Tell You Before You Buy in Black Forest

Two properties on the same road in Black Forest can sit less than 200 feet apart and draw from wells with completely different static water levels. That is not a rare edge case. It is a documented feature of how the Dawson aquifer behaves here, and it means the number that actually determines whether a five-acre parcel will serve a family for the next twenty years rarely shows up on the listing sheet at all.

Most buyers moving into Black Forest are comparing it to somewhere else, often a neighborhood on municipal or metro-district water where the tap just works and nobody thinks about where the water came from. That comparison misses the one variable that matters most here: almost every home in Black Forest runs on a private well tapping into the Denver Basin, and the basin is not one uniform tank of water. It is four separate aquifers stacked on top of each other, and which one your well reaches, and how thick that layer happens to be at your exact parcel, changes the entire ownership equation.

What the Listing Sheet Doesn't Show You

The Denver Basin aquifer system has four layers: the Dawson, the Denver, the Arapahoe, and the Laramie-Fox Hills, from shallowest to deepest. Most Black Forest wells reach into the lower Dawson, a confined layer sealed by impermeable rock above and below it. Because it is confined, almost none of the snow and rain that falls each year actually makes it back down into that layer. State officials generally treat the four aquifers as sealed off from one another, but drilling logs tell a messier story. Some tests show that pumping heavily from one layer can pull water levels down in the layer next to it, which means your well's future depends partly on what your neighbor's well is doing, not just your own usage.

There is a phrase water engineers use for this gap between paperwork and reality: paper water versus wet water. Having a legal allocation on file does not guarantee the physical water exists in that amount underground. A property can look identical to the one next door on every disclosure form and still behave completely differently once you turn on the tap for a few years.

The Contradiction Every Buyer Should Know About

Regional coverage of Denver Basin groundwater tends to paint a single grim picture: wells that used to produce 100 gallons per minute now struggling to hit 40, an aquifer system pumped far faster than it recharges. That picture is accurate at the basin level. But it flattens something a local well driller pointed out in reporting from the Black Forest Water & Wells committee: Black Forest wells specifically have held up better than wells to the north, around Castle Rock, where declines of up to 30 feet a year have been recorded. The reason comes down to geology, not luck. The Dawson formation is simply much thicker under Black Forest than it is farther north.

That thickness is not constant across the neighborhood, either. Black Forest sits near the southern edge of the entire Denver Basin, where the Dawson formation thins dramatically and disappears within less than ten miles. Near that edge, the formation creates what hydrogeologists call an abrupt boundary condition, a place where depletion accelerates faster than it does in the thick middle of the basin. Two homes inside the same subdivision, built the same year, can sit on meaningfully different sides of that boundary. The HOA name on the listing tells you nothing about which side you are on. Only the well log does.

A 2024 USGS study of groundwater levels across El Paso County's four Denver Basin aquifers found the deepest layer declining fastest: the Laramie-Fox Hills aquifer dropped an average of 9.9 feet a year, compared to 3.2 feet a year in the Denver aquifer and 1.9 feet in the Arapahoe. If a property's well reaches one of the deeper layers instead of the Dawson, it is sitting on a faster-declining resource, whatever the surface listing implies about acreage and privacy.

The Math Behind the Rules, and Every New Well Added to It

Colorado's statewide allocation model assumes an aquifer can be pumped dry over roughly a century. El Paso County adopted a more conservative standard in 1986, requiring developers to show enough water for 300 years, which works out to permitting only about a third of the state's standard annual allocation. That sounds protective, and in theory it stretches the same resource three times further. In practice, a developer only has to prove there is enough water on paper for 300 years. Nobody has to prove that water is actually extractable at an economical rate, which brings the paper water problem right back into play.

Meanwhile, new straws keep going into the same cup. Several developments already underway or recently approved near Black Forest draw on the same aquifer system homeowners here have relied on for decades:

  • Winsome/McCune Ranch, near Hodgen and Meridian roads, plans 143 lots, each with its own Dawson well.
  • Flying Horse North, at Hodgen and Black Forest roads, plans 283 lots on individual Dawson wells, plus a golf course irrigated from a separate Denver aquifer well.
  • The Ranch, near Londonderry and Stapleton roads, proposes 2,100 homes supplied by a metropolitan water district pumping from all four aquifers.
  • Retreat at TimberRidge, near Vollmer and Poco roads, splits its 215 homes between metro-district water and 51 individual Dawson wells.
  • Homestead, east of Vollmer and north of Woodmen, proposes as many as 5,228 dwelling units on district water.

The Cherokee Metropolitan District already operates four wells near Hodgen and Black Forest roads, pumping water to roughly 18,000 residents in southeast Colorado Springs. None of that water returns to Black Forest itself. Every one of these projects is a legitimate, permitted user of the same basin that existing Black Forest wells rely on, which is exactly why a well's current output matters more to a buyer than whatever number appears on the original 1980s or 1990s permit.

What This Actually Means During Your Diligence Period

A well permit on file with the Colorado Division of Water Resources only records the static water level measured at the time of drilling. It does not update itself. If you are buying a home with an existing well, that permit tells you what the aquifer looked like decades ago, not what it looks like this month. Getting a current reading means measuring it yourself or hiring a hydrogeologist, something almost nobody moving from a municipal-water market thinks to ask for.

A few other specifics worth building into an offer or inspection period:

  • Wells serving lots under 35 acres typically carry a household-use-only permit, which covers water inside the house and nothing else. No outdoor irrigation, no livestock watering, unless the permit specifically allows it.
  • Wells drilled after 1971 are usually capped near 15 gallons per minute for small domestic use, a hard ceiling regardless of how much land the home sits on.
  • A standard real estate water test through El Paso County Public Health runs about $80 and checks for nitrates, coliform, and E. coli. It is worth doing even on a well with a clean history, since neighboring wells only a few hundred feet away can produce noticeably different water.
  • Replacement wells for individual homeowners typically run $15,000 to $50,000 or more, a real swing that belongs in your math when comparing two otherwise similar properties.
  • A well permit does not transfer to a second house. If a parcel gets subdivided, each new lot needs its own well and its own permit, even if an existing well sits right on the property line.
  • Having a well permit is not the same as owning water rights. Colorado law treats all water as publicly owned and allocated through adjudication, so a permit lets you drill, but it does not by itself guarantee a legal right to the water.

Comparing Black Forest to Neighborhoods on Municipal Water

None of this makes Black Forest a riskier place to buy. It makes it a different kind of transaction. Neighborhoods on municipal or metro-district water, including much of Briargate, Monument, and Gleneagle, bundle the water question into a monthly utility bill and a system someone else maintains. Black Forest bundles it into the land itself. The acreage, the privacy, and the tree cover come with a due-diligence layer that simply does not exist on municipal water, and skipping that layer because the listing looks clean is how buyers end up surprised two years into ownership.

For a relocating buyer weighing a five-acre parcel in Black Forest against a comparable price point on a smaller municipal-water lot elsewhere in the region, the well log, the current static water level, and a fresh water test tell you more about the real cost of ownership than the price per acre ever will.

Does a well permit guarantee I own water rights? No. Colorado water law treats all water as publicly owned, and only adjudicated water rights convey ownership. A permit allows you to drill and pump under specific conditions, which is a separate legal question from who holds the underlying right.
