Supreme Court Decision Expands GI Bill Benefits for Veterans

Veterans now have the opportunity to receive up to 12 additional months of GI Bill education benefits, thanks to a Supreme Court ruling and subsequent policy changes announced by the Department of Veterans Affairs (VA). This development is a game-changer for veterans with multiple periods of service who qualify under the Montgomery GI Bill and Post-9/11 GI Bill programs.

What Changed?

Previously, veterans could access up to 36 months of education benefits under a single GI Bill program. However, the Supreme Court's 7-2 decision in April clarified that veterans with separate military service periods and eligibility under both GI Bill programs could receive up to 48 months of combined benefits.

The VA’s updated policy, revealed by Secretary Denis McDonough during the Student Veterans of America's national conference, extends benefits to an estimated 1.04 million veterans, with additional outreach underway to identify more eligible individuals.

Key Updates for Veterans

  • Veterans who served at least two separate military stints and met eligibility criteria for both GI Bills can now receive an extra year of benefits.
  • Applications for expiration date extensions must be submitted by October 1, 2030.
  • The VA will automatically process claims for 660,000 eligible veterans and notify others directly.

Extended GI Bill Benefits

Under this policy, veterans who paid into the Montgomery GI Bill can enjoy its benefits alongside the expanded offerings of the Post-9/11 GI Bill. These include tuition, fees, housing, books, and the flexibility to transfer benefits to dependents. The VA will also reinstate any unused Montgomery GI Bill time plus 90 days for veterans who transitioned to the Post-9/11 GI Bill.

Under Secretary for Benefits Joshua Jacobs stated that the change will positively impact not only future applicants but also many veterans who have already used their GI Bill benefits. This initiative ensures veterans can make the most of their well-earned educational opportunities.
