Colorado’s Legislative Flood and Its Impact on Housing Affordability

Colorado is in the midst of an affordability and competitiveness crisis. Over the past two years alone, state lawmakers have passed more than 1,000 new laws. While legislation is often intended to improve conditions, the volume and complexity are instead driving up costs, creating uncertainty for businesses, and adding to the strain on Colorado families.

According to the Common Sense Institute, legislative growth has spiked 69% since 2012, placing Colorado among the top three states for regulatory expansion. The increased number of bills, and their growing complexity, has weakened Colorado’s business climate and added significant compliance burdens.

 

Housing: A Case Study in Overregulation

The housing sector illustrates this problem clearly. In 2019, only 31 housing-related bills were passed. By 2025, that number had skyrocketed to 379. Yet, affordability has worsened:

 

  • In 2010, 47% of households could not afford the average Colorado home. By 2023, that figure had climbed to 60%.
  • Lower-priced homes under $300,000 make up just 15% of the market, even though 40% of households could afford them.

 

Despite the legislative surge, the availability of affordable homes has shrunk, leaving many families priced out of the market.

 

The Path Forward

Colorado doesn’t need more laws—it needs better laws. States like Montana, Nevada, North Dakota, and Texas meet every other year, demonstrating that stability and effective governance don’t require constant legislative churn.

To restore balance and competitiveness, Colorado must prioritize quality over quantity in lawmaking. Pro-business leadership that encourages investment, supports housing production, and reduces unnecessary costs is critical.

For families and homeowners, the consequences of unchecked regulation are real: higher housing costs, reduced availability, and a challenging economic environment. Colorado thrives when businesses grow, homes are attainable, and families can keep more of their earnings.
